Legal Information and General Terms and Conditions (GTC)

Scope and Contractual Partners

These terms and conditions contain the exclusively applicable conditions between you ("Customer") and us, anaj – Nils Haack, Stinnhorn 10c, 25469 Halstenbek, for contracts concluded via our online shop www.anajhome.eu.

Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but rather a non-binding online catalog, which serves as an invitation to place an order. By clicking the "Buy" button, you submit a binding order for the goods contained in the shopping cart. The confirmation of receipt of the order follows immediately after the order has been sent. The automatically generated confirmation email after receipt of the order does not constitute a declaration of acceptance on our part. This email merely confirms that we have received your offer. We can accept your order by sending an order confirmation via email or by delivering the goods within up to seven working days.

Price Information

All prices include the statutory value-added tax plus shipping costs. The shipping costs will be clearly communicated to you during the ordering process. The prices valid at the time of the order apply.

Payment

We offer you the payment methods of advance payment, PayPal, MasterCard, Visa, Google Pay, Apple Pay, and Klarna. We reserve the right not to offer certain payment methods for each order. Please note that any money transaction costs are to be borne by you.

We reserve the right to charge you flat-rate reminder fees as compensation for default in the amount of €5.00 per reminder if you are in default of payment. We allow you to prove to us that a significantly lower damage than the flat rate or no damage at all has been incurred.

Retention of Title

The goods remain our property until full payment has been made.

Invoice

You agree that we will only send invoices and credit notes to you in electronic form.

Shipping Cost Information

If delivery and shipping costs are incurred, they are indicated in the price.

Delivery

Delivery is made within Germany and to selected countries. The delivery time is usually 3-7 working days after receipt of payment, unless otherwise specified in the product offer. If the ordered product is not available because we are not supplied with this product by our suppliers without our fault, we can withdraw from the contract. In this case, we will inform you immediately and refund any payments already made without delay.

Partial Delivery

We reserve the right to make a partial delivery if it is reasonable for you and necessary for a quick processing. This will not incur any additional costs for you.

Technical Steps for Concluding a Contract

By pressing the corresponding on-screen buttons, you can select a category and an item within it. By pressing the "Add to Cart" button, you place the item in the shopping cart. By pressing the "Cart" button, you get an overview of your shopping cart. Here you can change the quantity of the selected items or delete items. By pressing the "Checkout" button, you will get to a page where you can select and determine the method of payment. You will be asked to enter your personal order details, such as name and delivery address, or to log in with your email address and personal password. This requires prior registration. If you have logged in before the order process, the step of entering personal order details is skipped, as you have already entered them during your registration. By pressing the "Buy" button in the order overview, you place a binding and chargeable order.

Information on Storage and Accessibility

We store the contents of the contract confirmation email, which contains the text of the contract. To permanently save the contract text, you should save and print the contract confirmation email. Upon conclusion of the contract, you will see the contract provisions including the General Terms and Conditions on your screen. Immediately after the conclusion of the contract, you will receive these by email. This gives you the opportunity to save the contract provisions including the General Terms and Conditions on a permanent data carrier, e.g., by saving the email sent to you by us or by taking a screenshot of the offer and printing it out. Furthermore, we advise you to print out and keep the respective offer displayed on the screen.

Detection and Correction of Input Errors

An effective and accessible technical means of correcting input errors is the "One Page Back" button on your browser. You can use this to correct input errors. Alternatively, you can also use the "Back to Cart" link. This is possible until you press "Buy." Another effective technical means of recognizing input errors is, for example, the magnification function in your browser display. Recognizing input errors presupposes that you have ensured and checked yourself that what you have entered, e.g., via the keyboard or mouse, corresponds to what you want. Ask yourself whether what you want and what you have entered match. Otherwise, cancel the process. Check your input before you finally press "Buy." You will receive further help when going through the order process, which is moderated by written instructions. Please check that the quantities in the shopping cart are correct before you press "Buy."

Promotional Vouchers

Promotional vouchers are vouchers that we have issued free of charge as part of promotional campaigns. Our promotional vouchers are generally valid for four weeks after the date of issue, unless otherwise stated on the voucher. Promotional vouchers are only redeemable during the specified period and only once as part of an order transaction. Brands, products, or product categories may be excluded from voucher promotions, or a promotional voucher may be limited to certain products. In addition, a promotional voucher may be linked to a minimum order value. Only one voucher can be redeemed within an order process. Promotional vouchers cannot be used to purchase gift vouchers. The value of our promotional vouchers cannot be paid out in cash, nor will its equivalent value earn interest. Promotional vouchers can only be redeemed before the completion of the order process. The resale of promotional vouchers is prohibited. If you use the promotional voucher for the simultaneous order of several items for which the voucher is valid, the voucher amount will be proportionally deducted from the individual prices of these items. This also applies if a minimum order value applies to the promotion, even if the minimum order value is already reached with one of the ordered items.

If you return one or more items, the discounted purchase price of the returned item(s) will be refunded. If you return one or more items for a promotion that had a minimum order value and subsequently fall below the minimum order value, the promotional voucher cannot be applied. This means that when we refund you for the returned items, we will deduct the full discount for the items you keep. There is no entitlement to a partial or full replacement of a promotional voucher in the event of a return.

Gift Vouchers

Gift vouchers are vouchers that you can purchase from us. Only one gift voucher can be redeemed within an order process. Gift vouchers cannot be used to purchase gift vouchers. The balance of our gift vouchers cannot be paid out in cash, nor will its equivalent value earn interest. Gift vouchers can only be redeemed before completing the checkout process. If you use the promotional voucher for the simultaneous order of several items for which the voucher is valid, the voucher amount will be proportionally deducted from the individual prices of these items. This also applies if a minimum order value applies to the promotion, even if the minimum order value is already reached with one of the ordered items. If you return one or more items, the discounted purchase price of the returned item(s) will be refunded.

Liability

Our products are subject to statutory defect liability rights unless otherwise agreed below: We shall be liable—regardless of the legal grounds—for damages or the reimbursement of futile expenses in accordance with the following provisions under letters (a) and (b):

(a) In the case of intent and gross negligence, we shall be liable without limitation. In the case of simple negligence, we shall only be liable for damages resulting from the breach of a material contractual obligation (an obligation whose fulfillment is essential for the proper execution of the contract and on whose compliance you regularly rely and may rely); in this case, however, our liability shall be limited to compensation for the foreseeable damage typical for the contract.

(b) The liability exclusions and limitations resulting from letter (a) shall not apply if we have fraudulently concealed a defect or assumed a guarantee for the quality of the goods, for damages resulting from injury to life, body, or health, as well as in the event of liability under the Product Liability Act. Insofar as liability towards us is excluded or limited, this shall also apply to the personal liability of our legal representatives and vicarious agents.

Warranty for Defects

Our products are subject to statutory warranty rights. We guarantee that the products purchased from us are free from defects for a period of two years from delivery of the goods to the consumer. This period also applies to consequential damage caused by defects, provided that no claims arising from unauthorized actions are asserted. The buyer's warranty rights, provided that they are a merchant within the meaning of the German Commercial Code (HGB), require that they have duly fulfilled their duties of inspection and notification of defects. In the event of justified complaints, the seller is entitled to two attempts at subsequent performance at its own expense. This may, at the buyer's option, be done by rectifying the defect or by delivering a replacement. The buyer must set a reasonable deadline for this. The seller may refuse subsequent performance that would incur disproportionately high costs. The buyer is not entitled to withhold or offset payments due to any complaints. Warranty claims cannot be asserted without a purchase receipt.

Contract Language

The languages available for the conclusion of the contract are German and English, with the contract being legally binding in German, and the English text provided purely for informational purposes.

Applicable Law

All legal relationships between the parties are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law only applies to the extent that the protection afforded is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.

We do not adhere to any codes of conduct.

In accordance with the German Telemedia Act (TMG), we hereby inform you that we collect, process, and use personal data by means of electronic data processing (EDP) to the extent necessary for the purpose of establishing, structuring the content of, or amending the purchase contract (purchase transaction). Information on Consumer Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS), which can be found at http://ec.europa.eu/consumers/odr/.

We are generally not obligated and not willing to participate in dispute resolution procedures before a consumer arbitration board. However, we will make every effort to resolve any dispute with the customer out of court and thus avoid legal action.

Right of Withdrawal for Consumers

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods. To exercise your right of withdrawal, you must inform us anaj – Nils Haack, Stinnhorn 10c, 25469 Halstenbek, info@anajhome.eu by means of a clear statement (e.g., a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory. To meet the withdrawal deadline, it is sufficient that you send the communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we must reimburse you for all payments we have received from you, including the delivery costs (except for the additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received the communication of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for this reimbursement. We may withhold reimbursement until we have received the goods back or you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us or to [insert here the name and address of the person authorized by you to receive the goods, if applicable] without undue delay and in any event no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Final Provisions

Should any provision of these General Terms and Conditions be invalid or become invalid, the validity of the remaining provisions shall not be affected.
